(CBS4) DENVER A judge dismissed nine Colorado county commissioners as defendants on Friday but the lawsuit against the state and Secretary of State Gigi Dennis still stands.The judge also ruled the touch screen voting machines will be allowed in the August primary.Lawyers who said they represented Colorado voters tried to stop the state from using the touch screen machines.The plaintiffs claimed the computers can be hacked into to change the outcome of an election. They also claimed the machines can create "phantom" and switched votes."We're disappointed that the county defendants have been dismissed from the case but we're delighted that the court has allowed our claim against the Secretary of State to move forward," said Mike Williams, the plaintiffs' attorney. "And we're very much looking forward to airing our grievances in a hearing in August."Secretary Dennis wouldn't comment on the hearing.
