How far can defaulting borrowers go at besmirching persons who appear to facilitate the sale of property they have given as security for loans? Tejinder Kaur Birdi, a widow, is a classic example of a borrower who would stop at nothing to protect her property even if it meant maligning the names of bankers, judges and court clerks. She set a dangerous precedent in 2003 when she reported to the police an alleged conspiracy by Fidelity Bank Managing Director, Mr Sultan Kassam Khimji, to murder her. Following the report, Khimji was arrested and charged in August 2004 with conspiracy to murder contrary to section 224 of the penal code. It was alleged that on diverse dates between the months of August and November 2003 in Nairobi, he jointly with others not before court, conspired to murder Birdi.
