Businesses concerned with rising Employment Tribunal claims
2006-07-27
There has been a rise in Employment Tribunal claims against employers in the last year, but the system has become more efficient, claims the Employment Tribunal Service’s (ETS) Annual Report. There has been a substantial rise in the number of claims received from employees, rising from 86,181 in 2004-05 to 115,039 in 2005-06. This includes an increase in "multiple claims", which have doubled to more than 63,000 in the last 12 months. The report says there is an average of 1.8 complaints per case. The total number of single claims in 2005-06 was around 52,000, 3,000 less than the previous year; however, these claims have started to rise again. The number of cases being withdrawn or settled before reaching tribunal also fell, from 67% to 60%. The report reveals the most frequent types of claim that the ETS has received in the last year: Unfair dismissal: 21% Working Time Directive: 18% Unauthorised deductions: 16% Breach of contract: 13% Sex, race and disability discrimination: 11% Equal pay: 8% Redundancy pay: 6% Other: 7% Claims have also become more complex according to the ETS and hearings are taking longer.
