A former Georgia College & State University student with a felony drug charge in Athens may avoid prosecution, his lawyer said Thursday. Thomas Stuart Carpenter, a 20-year-old from Fulton County, was charged with possession of heroin during the investigation of the death of his friend, Lewis Fish, a University of Georgia freshman who died in January from a lethal combination of alcohol, cocaine and heroin. A Wednesday hearing to dismiss the case was postponed, so District Attorney Ken Mauldin and Kim Stephens, Carpenter's attorney, could try to resolve the matter, Stephens said. Another date will be set if an agreement can't be reached. Stephens said he and Mauldin are looking at a pre-trial diversion program in which Carpenter would attend drug-related classes, group sessions and meet with a judge a few times a month.
